DA & code pathways
Duplex design & approvals
Dual occupancy in NSW can be approved through a council development application or, on qualifying lots, as complying development under the Low Rise Housing Diversity Code assessed by a registered certifier. The routes carry different design freedoms, timeframes and certainty profiles, and the right choice depends on the lot as much as the owner.
Scope
What this covers
Site-specific concept design testing footprints, private open space and parking for both dwellings
Documentation for the council DA route, including the reports each LGA requires
Code-pathway documentation where the lot meets the diversity code's standards
Acoustic and fire separation detailing for the party wall in attached configurations
BASIX, stormwater and landscape documentation coordinated across both dwellings
Timing
When it's needed
Design begins once qualification is settled. Owners intending to sell one side usually push for layouts and separations that support future title division, while owners holding both for rent may prioritise identical floor plans and low-maintenance finishes instead.
Redevelopment sites are working construction zones: stay outside the fencing, never let children explore cleared lots, and treat any suspected asbestos-containing material in an old dwelling as a matter for licensed assessors rather than a weekend job. Report unsecured fencing or open excavations to the site contact straight away.
Quote variables
What shapes the scope
Attached or detached form: the party wall changes structure, acoustics and cost
Whether the design must preserve a subdivision option later
Council appetite and controls where the DA route is used
Driveway, crossover and parking arrangements for two households on one frontage
Dual occupancy construction is residential building work under NSW law: it requires a contractor licence issued by NSW Fair Trading, written contracts in the prescribed form, and home building compensation cover for contracts above the statutory threshold before any deposit changes hands. Verify licences on the official register, and route subdivision, title and contract questions to registered surveyors and qualified legal advisers.
